Introduction to Litigation

 In a Post-Dispute Arbitration Agreement, one must persuade the court or prosecutor for optimal results. Litigation is often likened to a “war” in that it is based on conflicting parties at opposition, whereby one must analyze substantive evidence (or “weapons”) available to persuade the judges and potentially override objective facts. Litigation is largely divided into four branches: civil, criminal, administrative, and domestic, with huge procedural differences and strategies between each branch.

The procedure is divided into three stages: preservative measure, main litigation, and enforcement.

The preservation disposition aims to prevent the risk of failing to fulfill the lawsuit even if the court wins the case, and there are provisional disposition procedures for the other party’s property to secure the pecuniary claim, as well as injunction procedures. 

All matters of the dispute resolve at once such that once a ruling is laid down, a retrial is rare unless in the case of extenuating circumstances. The court has full authority to lay down a ruling as well as interpret and determine the facts. Additionally, the evidence established in the initial trial usually moves forward to later trials, so it is important to correctly establish the facts especially in multiple disputes. The arguments must be supported by real evidence; however, if there is a lack of real evidence, the argument must as persuasive as possible with circumstantial evidence. 

If the other party fails to fulfill its obligations after the ruling is finalized, there is a mandatory enforcement process executed by the court 
Since administrative litigation is a lawsuit against a state agency, it is often difficult (compared to that of other legal procedures) for the plaintiff to obtain evidence.   In administrative litigation, the purpose of the lawsuit is to cancel the disposition issued by an administrative agency. However, in many cases, an application for suspension of execution is requested as a separate procedure to suspend the effect of the disposition until judgment. The procedures are conducted on separate days, and it is more common to file a lawsuit after deciding to suspend execution.   In order to effectively respond to administrative litigation, it is necessary to carefully review all documents relevant in the disposition and determine whether administrative agency’s disposition was in accordance to the law, whether there were any other solutions available, and whether the punishment by the administrative disposition is proportionate to what was originally intended.

Introduction to Arbitration

Arbitration is a means of settling a dispute of fact, law, or procedure between parties that have contractually agreed to submit to a neutral third party without court action. Typically, the parties have agreed to voluntarily submit to the procedure and be bound by the arbitrator’s award.

Korea implemented the Korean Arbitration Act in 1966, signed the New York Convention of 1973 in 1958, and adopted the UNCITRAL Model law in 1999 and incorporated the 2006 UNCITRAL revisions in 2016. In short, Korea has been a pioneer in Asia by adopting and using arbitration as a dispute settlement nation-wide. Further, since the 2000s, Korean companies have adopted arbitration clauses as the preferred method to international dispute settlement.

Arbitration is different, and each arbitral institution has different procedural rules. It is distinct from litigation in that it requires written and oral advocacy skills as well as extensive legal knowledge.

민사소송의 경우 수십억 원대의 금전거래가 문제된 사건, 복수 부동산에 대한 소유관계 분쟁, 해고 등 노동관계 분쟁, 대형 건설사들을 상대로 하는 수백억 원대의 공사대금 소송 등 큰 규모의 사건들을 다수 수행해 왔습니다. 수행한 사건들의 면면을 살피더라도 명시적인 처분문서가 있음에도 그 처분문서의 효력에 정면으로 반대되는 결론을 이끌어내거나, 직접증거가 거의 존재하지 않는 상황에서 공문서에 기재된 불리한 내용을 효과적으로 방어하여 궁극적으로 전부승소 판결을 이끌어내는 등 그 난이도도 높은 편에 속합니다.

형사소송의 경우 피해액이 수백억 원대에 이르는 사기 사건, 동업자 간 분쟁에서 비롯된 제품 소유권 분쟁, 암호화폐 거래소와 관련된 사기 등 재산범죄 사건, 출입국관리법 위반 사건, 성범죄 사건, 명예훼손 사건 등 폭넓은 분야를 깊이 있게 다루어본 경험이 있습니다. 출입국관리법 위반 사건에서 치열한 법리 다툼 끝에 피고인에 대해 무죄 판결을 이끌어내기도 했고, 성범죄 사건에 역시 사안의 특성에 맞는 소송전략으로 무죄 판결을 다수 이끌어내기도 하였으며, 공공기관 내부 감사와 관련된 분쟁에서 피의자를 변호하여 검찰의 무혐의결정을 받아낸 사례도 있습니다. 또한 불기소처분에 내려진 사건에서 불기소처분 취소 및 재기수사명령을 받아낸 끝에 결국 검찰의 기소를 이끌어내기도 하였고, 피해액 약 23억원의 사기 사건 피해자의 항고절차를 조력하여 기소에 이르게 하는 등 성공사례가 다수 축적되어 있습니다.

행정소송의 경우에도 공장의 인허가절차 과정에서 내려진 처분에 대해 행정심판 결과를 뒤집고 전부승소의 결과를 이끌어낸 사례가 있고, 의사면허정지처분 취소소송에서 처분 취소의 결과를 이끌어내기도 하였습니다. 그뿐 아니라 디라이트 송무 PG 구성원들은 식약처, 출입국외국인청(출입국관리법), 보건복지부 등 다수의 행정기관과 관련된 다양한 처분을 소송을 통해 다룬 경험이 있어 개별 법리에도 이해도가 높습니다.
