Review of whether a third party’s exclusive distribution right is infringed

At the request of a domestic record distributor, D’LIGHT Law Group reviewed whether a third party who knows that a record producer has signed a record distribution contract that grants exclusive distribution rights to the record distributor is liable for damages when the record is used without permission. First, D’LIGHT Law Group, reviewed whether the above record distribution contract could be interpreted as an exclusive license establishment contract, and then reviewed whether infringement of bonds (exclusive record distribution rights) due to third parties could be recognized. D-Light, a law firm, judged that it could constitute a bond infringement by a third party under specific facts and presented the criteria for calculating damages.
