Review of Chinese fonts programs and fonts’ authorship and the scope of indemnification under the game IP license agreement

In the case where a domestic game company signed a contract to license a game IP to a Chinese game company and provided graphic resources to a Chinese game company, the law firm D’LIGHT Law Group was requested by a domestic game company, and the graphic resource was used without a license. In the case of text written in a Chinese font program, we reviewed whether domestic game companies are liable for indemnification and the scope of damages to Chinese game companies. D’LIGHT Law Group first reviewed the Chinese font program and the authorship of the font created using it according to the attitude of Chinese law and precedent, and accordingly, just using the font included in the image without using the font program directly, can be used by Chinese game companies. We reviewed whether the liability for indemnification and liability for damages can be recognized. In addition, if the font is recognized as an art work, we reviewed the details of the damages to Chinese game companies under the IP use contract.
